RESUMO

El Real Decreto 601/2019 de 18 de octubre es fruto de la transposición parcial al ordenamiento jurídico español de la Directiva EURATOM 59/2013. Este Real Decreto recoge los mandatos de la Directiva relacionados con la necesidad de justificar y optimizar la exposición médica, incluida la de personas asintomáticas, la propuesta de requisitos más estrictos en cuanto a la información que debe proporcionarse al paciente, el registro y la notificación de las dosis de los procedimientos médico-radiológicos, el uso de niveles de referencia para diagnóstico y la disponibilidad de dispositivos indicadores de dosis. El artículo revisa los aspectos más relevantes y novedades relacionadas con los principios de justificación, optimización, control de dosis y las obligaciones derivadas del derecho a la información y el consentimiento. El Real Decreto considera fundamental que exista un alto nivel de competencia, y una nueva enumeración de responsabilidades y funciones de los radiólogos, las cuales se detallan y analizan.(AU)


The Royal Decree 601/2019 of 18th october is the result of the partial transposition into the Spanish legal system of the EURATOM Directive 59/2013. This Royal Decree includes the mandates of the Directive related to the need to justify and optimize medical exposure, including that of asymptomatic people, proposal of stricter requirements regarding the information that must be provided to the patient, registration and notification of the doses of medical-radiological procedures, use of reference levels for diagnosis and the availability of dose-indicating devices. The article reviews the most relevant aspects and novelties related to the principles of justification, optimization, dose control and the obligations derived from the right to information and consent. This Royal Decree considers essential for radiologists to develop a high level of competence and a new list of responsibilities and functions, which are detailed and analysed in this article.(AU)

The Royal Decree 601/2019 of 18th October is the result of the partial transposition into the Spanish legal system of the Euratom Directive 59/2013. Teleradiology is the electronic transmission of radiological images from one location to another with the main purpose of interpreting or consulting a diagnosis and must be subject to codes of conduct agreed upon by professional societies. The content of fourteen teleradiology best practice guidelines is analyzed. Their guiding principles are: the best interest and benefit of the patient, quality and safety standards homologous to the local radiology service, and use as a complement and support of the same. As legal obligations: guaranteeing rights by applying the principle of the patient's country of origin, establishing requirements in international teleradiology and civil liability insurance. Regarding the radiological process: integration with the local service process, guaranteeing the quality of images and reports, access to previous studies and reports and complying with the principles of radioprotection. Regarding professional requirements: compliance with the required registrations, licenses and qualifications, training and qualification of the radiologist and technician, prevention of fraudulent practices, respect for labor standards and remuneration of the radiologist. Subcontracting must be justified, managing the risk of commoditization. Compliance with the system's technical standards.

La telerradiología es la trasmisión electrónica de imágenes radiológicas de una localización a otra con el propósito principal de interpretar o consultar un diagnóstico y debe estar sujeta a códigos de conducta consensuados por sociedades profesionales. Se analiza el contenido de 14 guías de buenas prácticas de telerradiología. Sus principios rectores son: el mejor interés y beneficio del paciente, estándares de calidad y seguridad homologables al servicio de radiología local, y utilización como complemento y apoyo del mismo. Como obligaciones legales: garantizar los derechos aplicando el principio de país de origen del paciente, establecer requisitos en telerradiología internacional y seguro de responsabilidad civil. Con respecto al proceso radiológico: integración con el proceso del servicio local, garantizar la calidad de imágenes e informes, el acceso a los estudios e informes previos y cumplir los principios de radioprotección. En relación con los requisitos profesionales: cumplir con los registros, licencias y cualificaciones exigidas, formación y capacitación del radiólogo y técnico, prevención de prácticas fraudulentas, respeto a las normas laborales y remuneración del radiólogo. La subcontratación debe estar justificada, gestionando el riesgo de comoditización. Cumplimiento de estándares técnicos del sistema (AU)

RESUMO

Urgent imaging accounts for more than 50% of the overall activity in diagnostic imaging departments. The enormous impact of this workload makes the appropriate organization and management of urgent imaging essential. Providing urgent imaging services aims to meet the needs of urgent and critical patients from both within the hospital (wards) and outside it (emergency department). To achieve these aims, all hospitals should have a specific unit for urgent imaging. This unit should be large enough to deal with the volume of activity and it should be provided with the human, technological, structural, and organizational resources necessary to fulfill this mission.

La demanda asistencial de radiología urgente supone más del 50% de la actividad global de los servicios de radiodiagnóstico. Esto representa un enorme impacto que hace imprescindible una adecuada organización y gestión de los mismos. La prestación de servicios de urgencias radiológicas tiene la misión de atender a las urgencias, emergencias y los pacientes críticos procedentes de los servicios clínicos, tanto externos (servicio de urgencias), como internos (servicios hospitalarios). Para el cumplimiento correcto de esta misión todos los hospitales deberían contar con una unidad específica de radiología de urgencias, apropiadamente dimensionada al volumen de actividad a desarrollar, dotada de los medios humanos, tecnológicos, estructurales y organizativos adecuados para cumplir esa misión (AU)

RESUMO

El actual sistema de formación especializada mediante residencia en España tiene su origen en 1963, siendo el radiodiagnóstico una de las especialidades iniciales. Las normas que rigen actualmente la formación especializada son de 3 tipos: a) profesionales, Ley de Ordenación de las Profesiones Sanitarias; b) laborales, Estatuto del Residente, y c) educativas: Nueva Ley de Especialidades y Programa de Radiodiagnóstico.Este sistema incluye una relación contractual exclusiva con la entidad formadora; un sistema de acceso unificado, y una formación programada, tutelada y evaluada, basada en la responsabilización progresiva, en unidades acreditadas. El residente tiene derecho a ser formado y evaluado, a participar en su unidad docente y a sus derechos laborales. A cambio, se obliga a realizar las tareas del programa y a cumplir las normas del centro. El residente de primer año deberá ser supervisado directamente pasándose después a una progresiva delegación (AU)

RESUMO

The current system for training medical specialists in Spain originated in 1963, and diagnostic radiology was one of the first specialties recognized. There are currently three types of regulations that govern the training of specialists: a) professional, The Health Professions Law; b) labor: The Residents' Statute; and c) educational, The New Medical Specialties Law and the Diagnostic Imaging Program This system consists of an exclusive contract with the training organization, a unified system of access, and a training program in accredited units that includes tutoring, evaluation, and progressive assignment of responsibilities. Residents have a right to be trained and evaluated, to participate in the teaching unit, and to their labor rights. In exchange, they must complete the tasks assigned in the program and abide by the institution's rules. Residents must be supervised directly in the first year and thereafter they should be given progressively more responsibility.
